1. General Information
Travel Well With Mel, LLC is an Arizona-based independent travel agency affiliated with Levarte Travel. We arrange travel experiences and bookings through independent third-party providers (“Suppliers”), such as airlines, hotels, cruise lines, and tour operators. We do not own or operate these services and are not liable for their actions or performance.
2. Role as Agent
We act solely as your agent when booking travel-related services. All Travel Products—like flights, accommodations, cruises, tours, and travel insurance—are provided by vetted Suppliers who operate under their own terms and policies. By booking through us, you agree to their terms and conditions. Please read all documentation and Supplier policies carefully.
3. Airfare
Airfare arrangements are subject to the terms of the airline or charter operator. We are not liable for airline changes, baggage fees, cancellations, delays, or frequent flyer issues. Charter flights may change times or routes with limited notice. Always reconfirm your flight directly with the airline 24 hours before departure and check for updated baggage policies.
4. Traveler Information & Passport Requirements
It is your responsibility to ensure all personal details—like full name, date of birth, and passport information—are accurate when making a booking. Mistakes may result in additional fees or require new tickets. Notify us of any discrepancies within 24 hours of receiving travel documents. Travel Well with Mel, LLC highly recommends that all travelers carry a valid passport with at least six months’ validity beyond the return date of travel. This is essential in the event of a missed departure, emergency disembarkation, or international flight re-routing. Traveling without a valid passport may result in significant delays and complications upon re-entry to the United States.
5. Travel Insurance
Travel insurance is strongly recommended but not included in your trip cost. We advise purchasing a policy that covers trip cancellation, interruption, medical emergencies, evacuation, and baggage loss—ideally with Cancel For Any Reason (CFAR) benefits. Travel Well With Mel, LLC can refer you to trusted insurance providers but cannot guarantee coverage or answer technical policy questions. If you decline coverage, you accept full responsibility for any losses or expenses due to trip cancellation, delay, or interruption, and acknowledge that refunds will not be issued. Some destinations require proof of medical insurance for entry; Travel Well With Mel, LLC is not liable if you are denied entry due to lack of coverage. By signing this form, you confirm that travel insurance has been offered to you, the associated risks of declining have been explained, and if you choose not to purchase coverage, you do so at your own risk.
6. Assumption of Risk & Liability Waiver
Travel involves inherent risks, including but not limited to illness, accidents, natural elements, acts of terrorism, pandemics (including COVID-19), and the actions or negligence of others. You understand and accept these risks as part of your travel experience.
By booking with Travel Well With Mel, LLC, you agree to release and hold harmless Travel Well With Mel, LLC, its employees, and affiliates from any liability, including third-party negligence. This waiver applies to you and your heirs and remains in effect even after the trip or termination of these terms.
7. Cancellation Policy
All bookings are non-refundable, including cancellations due to illness or COVID-19. We strongly urge you to secure travel insurance with CFAR coverage to protect your investment. If your Supplier cancels or changes your booking, we will assist in communicating alternatives but bear no further responsibility for changes or refunds outside our control.
8. Force Majeure
Travel Well With Mel, LLC is not liable for delays, cancellations, or losses caused by events beyond our control, including but not limited to: natural disasters, weather, strikes, riots, war, terrorism, pandemics (including COVID-19), government actions, or other unforeseeable events. These events are considered force majeure. In such cases, we are not required to issue refunds, but if we recover any funds from Suppliers, we will pass them along to you without additional charges.
9. Travelers with Disabilities
We will communicate accessibility requests to Suppliers but cannot guarantee accommodations, especially outside the U.S. where ADA compliance may not apply. Travelers requiring assistance must travel with a companion who can provide it, at their own expense. Please notify us at the time of booking if you have a disability; a doctor’s note may be required to confirm fitness to travel.
10. Limits of Liability
To the extent allowed by law, Travel Well With Mel, LLC is not liable for indirect, incidental, or consequential damages, such as lost profits, delays, emotional distress, or employment changes related to your trip. We are not responsible for matters beyond our control.
11. Non-Responsibility Disclaimer
Travel Well With Mel, LLC works with independent third-party Suppliers (e.g., airlines, hotels, transportation providers) and does not control or operate these services. We are not responsible for their acts, omissions, or the condition of their services.
By booking, you acknowledge Travel Well With Mel, LLC and its team are not liable for injury, loss, delay, or property damage. In the rare event of a claim, our liability is limited to the commission or fees we earned from your booking. We reserve the right to decline or terminate bookings at our sole discretion.
12. Assumption of Risk / Waiver
Traveler understands that travel may involve risks, including injury, illness (including COVID-19), or death from natural elements, accidents, food or water contamination, or negligence by others (including Travel Well With Mel, LLC or third parties). Traveler voluntarily accepts these risks and agrees not to sue Travel Well With Mel, LLC or its representatives for any claims arising from the trip. This release applies to traveler’s heirs and remains in effect even after the trip or termination of this agreement.
13. Indemnification
Traveler agrees to indemnify and hold harmless Travel Well With Mel, LLC and its representatives from any losses, legal claims, or expenses (including attorney’s fees) resulting from:
(i) breach of this agreement,
(ii) traveler’s actions or negligence,
(iii) force majeure events, or
(iv) third-party claims related to the above.
This clause remains effective even if this agreement ends.
14. Time Limit for Legal Claims
Any claim relating to the trip must be filed within 6 months of the incident or injury, regardless of any longer period allowed by law. Claims made after this period are waived.
15. Photo & Feedback Release
Traveler grants Travel Well With Mel, LLC permission to use photos, videos, and feedback shared or posted online (e.g., social media tags) for promotional use, without compensation. Travelers may request removal by emailing the address below.
16. Governing Law & Venue
This agreement is governed by Arizona law. Any disputes must be resolved in a court in Maricopa County, Arizona.
17. Electronic Communications
You agree to receive electronic communications (email, text, etc.) and acknowledge these fulfill any legal requirement for written communication.
18. Entire Agreement & Severability
This document, along with Supplier terms and any provided invoices, forms the full agreement. If any part is invalid, the rest remains in effect. Travel Well With Mel, LLC’s failure to enforce any part of this agreement does not waive its rights.
19. Interpretation
Any ambiguity in these Terms shall not be interpreted against Travel Well With Mel, LLC as the drafting party.
